1. Acceptance of Terms

This web page represents a legal document that serves as our Terms of Use. It governs the legal terms of our website, https://imoveit.app, and any related applications, as owned by Linx Systems CC.

2. Governing Law

 Except as otherwise set forth in these Terms, these Terms shall be exclusively governed by and construed in accordance with the laws of South Africa, excluding its rules on conflicts of laws.

3. Limitation Of Liability

ImoveIt SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF UBER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ImoveIt SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY THIRD PARTY PROVIDER, EVEN IF ImoveIt HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ImoveIt SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND UBER’S REASONABLE CONTROL. 

General Access and Use of the Service

Subject to the terms and conditions of this Terms of Use, You may access and use the Service only for your internal business purposes as long as you have a valid subscription license. You shall not allow any unauthorized user to access or use the Service. You shall not license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share or otherwise commercially exploit or make the Service available to any third party, other than as expressly permitted by this Terms of Use; copy, modify or distribute any portion of the Service; use the Service to process data on behalf of any third party; or use the Service in any unlawful manner or in any manner that interferes with or disrupts the integrity or performance of the Service and its components.

Outside of South Africa

1. ImoveIt Services are operated and managed on servers located and operated within the Republic of South Africa. In order to provide our Services to you, we may send and store your Personal Information outside of the country where you reside or are located, including to South Africa.
2. Accordingly, if a User resides or is located outside of South Africa, your Personal Information may be transferred outside of the country where you reside or are located, including to countries that may not or do not provide the same level of protection for your Personal Information.
3. ImoveIt is committed to protecting the privacy and confidentiality of your Personal Information when it is transferred. We shall take appropriate steps to provide the same level of protection for the processing carried out in any such countries, as you would have within your country to the extent reasonably feasible under applicable law.
4. By using and accessing our Services, Users who reside or are located in countries outside of South Africa agree and consent to the transfer to and processing of their Personal Information on servers located outside of the country where they reside, and that the protection of such information may be different than required under the laws of their residence or location.
5. The User agrees that their Personal Information may be transferred cross-border to other countries (outside of South Africa) for processing, provided that these countries abide by the provisions in the POPI Act relating to such transfer.
